Новый указ, направленный на улучшение условий для иностранных инвесторов, включая резидентов «недружественных» государств принят в РФ.

При сохранении введенных ранее российских контрсанкций иностранцам даются гарантии для операций с ценными бумагами и производными финансовыми инструментами, а также размещения депозитов.

Новый указ вводит счета типа «Ин», с которых иностранные инвесторы смогут беспрепятственно инвестировать в российскую экономику. Перечень разрешенных инвестиций включает сделки с ценными бумагами на бирже, размещение средств на депозитах и даже заключение сделок с деривативами на срочном рынке. 

На новый тип счетов иностранным инвесторам разрешается переводить из-за рубежа рубли и иностранную валюту. Указ закрепляет и возможность вывода средств, в том числе за рубеж, но пока нет ясности, как это будет осуществляться технически.

A draft of the so-called “Big Sanctions Act” was recently announced in Poland 🇵🇱 .

Poland aims to adjust Polish law to the EU sanctions regulations but also to further strengthen its national sanctions regime, operating autonomously from EU sanctions.

𝗞̲𝗲̲𝘆̲ ̲𝗠̲𝗲̲𝗮̲𝘀̲𝘂̲𝗿̲𝗲̲𝘀̲:̲
🔴 A 𝗻𝗲𝘄 𝗹𝗶𝘀𝘁 𝗼𝗳 𝗱𝗲𝘀𝗶𝗴𝗻𝗮𝘁𝗲𝗱 𝗶𝗻𝗱𝗶𝘃𝗶𝗱𝘂𝗮𝗹𝘀 𝗮𝗻𝗱 𝗲𝗻𝘁𝗶𝘁𝗶𝗲𝘀 𝘄𝗶𝗹𝗹 𝗯𝗲 𝗰𝗿𝗲𝗮𝘁𝗲𝗱. This will be a separate autonomous list from the existing Russia & Belarus-related list.
There will be two main sanctions lists:
• One under the Small Sanctions Act (linked to RU & BY sanctions),
• One under the Big Sanctions Act.
(There is also a third list maintained by the Polish FIU, though it is very short.)

🔴 The draft law establishes a legal basis for 𝘁𝗲𝗺𝗽𝗼𝗿𝗮𝗿𝘆 𝗯𝗮𝗻𝘀 𝗼𝗿 𝗿𝗲𝘀𝘁𝗿𝗶𝗰𝘁𝗶𝗼𝗻𝘀 𝗼𝗻 𝗲𝗰𝗼𝗻𝗼𝗺𝗶𝗰 𝗰𝗼𝗼𝗽𝗲𝗿𝗮𝘁𝗶𝗼𝗻 𝘄𝗶𝘁𝗵 𝘀𝗽𝗲𝗰𝗶𝗳𝗶𝗰 𝗰𝗼𝘂𝗻𝘁𝗿𝗶𝗲𝘀. These measures go beyond a typical national export control list, and includes:
• Restrictions on trade in certain goods,
• Transit of goods through Poland,
• Provision of services,
• Financial transactions and insurance operations.

𝗣̲𝗲̲𝗻̲𝗮̲𝗹̲𝘁̲𝗶̲𝗲̲𝘀̲:̲
🧨 𝗜𝗺𝗽𝗿𝗶𝘀𝗼𝗻𝗺𝗲𝗻𝘁: 𝗙𝗿𝗼𝗺 𝟯 𝗺𝗼𝗻𝘁𝗵𝘀 𝘂𝗽 𝘁𝗼 𝟭𝟬 𝘆𝗲𝗮𝗿𝘀, 𝗱𝗲𝗽𝗲𝗻𝗱𝗶𝗻𝗴 𝗼𝗻 𝘁𝗵𝗲 𝗻𝗮𝘁𝘂𝗿𝗲 𝗼𝗳 𝘁𝗵𝗲 𝘃𝗶𝗼𝗹𝗮𝘁𝗶𝗼𝗻.
Violations include:
• Failing to freeze assets or making assets available to designated parties,
• Engaging in prohibited trade in goods,
• Providing prohibited services,
• Circumventing sanctions,
• Submitting false or misleading information to hide the ownership or control of frozen funds or economic resources.

🧨 𝗨𝗽 𝘁𝗼 𝟮𝟬𝟬 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 𝗣𝗟𝗡 (𝗮𝗽𝗽𝗿𝗼𝘅. €𝟰𝟳 𝗺𝗶𝗹𝗹𝗶𝗼𝗻) 𝗼𝗿 𝟱% 𝗼𝗳 𝗮𝗻𝗻𝘂𝗮𝗹 𝘁𝘂𝗿𝗻𝗼𝘃𝗲𝗿
Legal entities may be held liable for acts committed by individuals acting on their behalf or in their interest. Importantly, liability is independent of whether a court ruling has been issued against the individual involved in the offence.

𝗟̲𝗲̲𝗴̲𝗮̲𝗹̲ ̲𝗳̲𝗿̲𝗮̲𝗺̲𝗲̲𝘄̲𝗼̲𝗿̲𝗸̲:̲
If adopted, sanctions will still be governed simultaneously under a few legal acts:
⚖️ the “Small Sanctions Act” (already in force – adopted in 2022 and amended in 2025 to reflect EU sanctions on Russia and Belarus, while also unilaterally extending their scope),
⚖️ the “Big Sanctions Act” (draft available),

and:
⚖️ the AML Regulation (already in force, with significant sanctions-relevant amendments underway).
⚖️  Act on National Tax Administration and the
⚖️ Act on the Liability of Collective Entities for Offences Prohibited under Penalty.
