The Principle of Non-Retroactivity in Light of the Newly Enacted Asset Recovery Proclamation No. 1364/2017

The newly ratified proclamation blends civil and criminal principles, allowing asset recovery based on a balance of probabilities standard and placing the burden of proof on the defendant.
It permits the state to reach back 10 years, raising key constitutional concerns:
