Ng had the power to remove or amend the messages in the channel, but he “allowed them to exist.” So far, more than a dozen different members have contributed to the group, posting voice notes of themselves screaming, yelling, groaning, and wailing in various pitches and rhythms. Other crimes that the SUCK Channel incited under Ng’s watch included using corrosive chemicals to make explosives and causing grievous bodily harm with intent. The court also found Ng responsible for calling on people to assist protesters who clashed violently with police at several universities in November 2019. In handing down the sentence yesterday, deputy judge Peter Hui Shiu-keung of the district court said that even if Ng did not post the messages, he cannot shirk responsibility as the owner and administrator of such a big group for allowing these messages that incite illegal behaviors to exist. “[The defendant] could not shift his criminal liability,” Hui said.
