§ 81 Abs. 4 AufenthG

Beantragt ein Ausländer vor Ablauf seines Aufenthaltstitels dessen Verlängerung oder die Erteilung eines anderen Aufenthaltstitels, gilt der bisherige Aufenthaltstitel vom Zeitpunkt seines Ablaufs bis zur Entscheidung der Ausländerbehörde als fortbestehend. Dies gilt nicht für ein Visum nach § 6 Absatz 1. Wurde der Antrag auf Erteilung oder Verlängerung eines Aufenthaltstitels verspätet gestellt, kann die Ausländerbehörde zur Vermeidung einer unbilligen Härte die Fortgeltungswirkung anordnen.

If a foreigner applies for an extension of his or her residence title or for a different residence title before his or her current residence title expires, the current residence title is deemed to remain in force from the time it expires until the time of the decision by the foreigners authority. This does not apply to visas issued in accordance with section 6 (1). If the application to issue or extend a residence title was filed too late, the foreigners authority may order that the previous residence title remains valid in order to avoid undue hardship.

طبق قانون ۸۱ اقامت، بند ۴، چنانچه دارنده اقامت موقت آلمان قبل از انقضای اقامت خود از اداره خارجی‌ها درخواست تمدید اقامت یا تبدیل آن به نوع دیگری از اقامت نموده است ولی قرار مصاحبه دریافت ننموه است، اقامت فعلی او حتی بعد از انقضاء تا زمان تصمیم گیری اداره خارجی‌ها معتبر می‌باشد‌‌. این قانون شامل ویزاهای بلندمدت مثل دانشجویی هم می‌گردد ولی درباره ویزاهای کوتاه مدت مثل شنگن و ترانزیت صدق نمی‌کند‌‌.

لذا چنانچه دارای اقامت یا ویزای دانشجویی/کاری/تحقیقاتی/بلوکارت... آلمان بوده و قبل از انقضای اقامت یا ویزای خود برای تمدید یا تغییر آن اقدام نموده‌اید ولی هنوز وقتی دریافت نکرده اید، اقامت شما در آلمان حتی بعد از انقضای اقامت یا ویزایتان قانونیست و با مشکلی روبرو نخواهید شد.
