📌ماده 1129 ـ در صورت استنکاف شوهر از دادن نفقه و عدم امکان اجراي حکم محکمه و الزام او به دادن نفقه زن مي‌تواند براي طلاق به حاکم رجوع کند و حاکم شوهر را اجبار به طلاق مي‌نمايد .همچنين است در صورت عجز شوهر از دادن نفقه .
